Lawyer.com Member Questionnaire Please describe a case(s) in the last year or two where you made a big difference. In May, 2008 I represented an East Indian family that had been involved in a terrible car accident. The father and three children were hit while driving home. The father was pretty banged up with soft tissue and internal injuries. Sadly, two out of the three children had brain damage. The case was schedule for a trial on May 1, 2016. However, we settled before that date for $5M. The family received their payment by the end of 2016. I worked with another lawyer on that case, but I played a big role in its success. How did you build a successful practice? I built a successful practice through hard work, natural talent, and pushing myself to be better. Both parents were hard workers – my father died at an early age and literally worked himself to death. My mom was employed as a janitor, then went back to school in her 40s to get a high school degree equivalent. She then worked as bookkeeper and a cook. She worked until age 69 and spent the last decade of her working life getting up 4:30 every morning to drive with a co-worker to a pond (12 miles into the woods) to cook for kids at biology camp. Then my three brothers and I went to law school and helped her out financially. I excelled academically, which I attribute to the work ethic I inherited from my parents and from natural talent. I am proud to say that I earned multiple scholarships throughout my academic career. Ambition and dedication got me through school, and I bring those same traits to my practice today. For that reason, I still love working, and I look forward to the new challenge that each day brings. I genuinely enjoy helping people and do a lot of pro bono work. What is the most rewarding aspect of your job? To be totally exhausted at the end of the day, knowing that I gave everything I had to help make someone’s life better. |

2 | 2017-07-13 23:58:41 | Daniel Simon Freudman | Criminal, Litigation, Collection, Juvenile Law, Lawsuit | Bond Univ LL.B. 2010 | In Good Standing | Daniel Freudman is a barrister and solicitor with offices located in downtown Toronto. He provides professional legal services to clients within the GTA and across Ontario, including Brampton, Scarborough, Oshawa, Newmarket, Milton, Orangeville and Hamilton. Daniel rigorously defends persons charged with a wide array of offences under the Criminal Code of Canada (CCC), Controlled Drugs and Substances Act (CDSA), Highway Traffic Act (HTA) and other provincial and federal legislation. Daniel also represents individuals and small businesses involved in legal disputes, litigating actions in the Superior Court and Small Claims Court across the province. Daniel Freudman has a Bachelor of Laws (LLB) as well as an undergraduate degree in Commerce (BComm). He attended Bond University's Faculty of Law, one of Australia's highest ranking law schools, and graduated with Honours. While in Australia, Daniel tutored criminal law, and worked at a civil litigation firm in downtown Sydney, specializing in Personal Injury claims. After graduating law school, Daniel returned to his hometown of Toronto, where he completed his Articles of Clerkship at a reputable and busy law firm practicing exclusively in criminal law. There, he gained invaluable experience working on murder cases, drug/gun project cases and other high profile matters. Following completion of his Articles, Daniel started up his own practice, Freudman Law, as he wished to manage his own client base and give each client the personal attention they deserve. Daniel was dissatisfied with the “big firm” practice of passing around files from associate to associate, with the clients seldom knowing who has present carriage of their case. At Freudman Law, Daniel has carriage and intimate knowledge of each and every case, and provides clients with his personal cell phone number (647-771-2416) so they can reach him at any time to discuss their case or receive status updates. Daniel has conducted dozens of trials, both civil and criminal, in courthouses within the GTA and across Ontario. Daniel has appeared before the Ontario Court of Justice (both Criminal Division and Youth Court), the Ontario Superior Court of Justice (both Civil and Criminal), Small Claims Court and other tribunals. Daniel has also prepared and conducted appeals to the Divisional Court of Ontario, before both a single judge as well as a panel of judges. In his free time, Daniel enjoys travelling, kitesurfing, hockey and learning new languages. Daniel speaks conversational Spanish, but can also engage in basic pleasantries in several other languages, including German, Hebrew, Mandarin, Italian and Polish. Daniel continues to develop his Spanish vocabulary, and is also presently learning Russian through audiobooks. Lawyer.com Member Questionnaire Please describe a case(s) in the last year or two where you made a big difference. Client facing numerous charges including sexual assault and human trafficking; Crown was seeking lengthy term of imprisonment upon conviction. Several media outlets reported on the incident, vilifying client despite the presumption of innocence. I hired a private investigator to expose serious inconsistencies in complainant's story and ultimately was able to get Crown to unconditionally drop all charges. I then contacted media outlets to request they rectify their reports to reflect client's innocence. Client was vindicated, able to return to his schooling without the hindrance of any criminal record. How did you build a successful practice? Individual attention to each and every client, with specific knowledge of their case at all times, and able to be reached at any given time to discuss such. What should clients look for in a lawyer? Someone they can trust and confide in. The more open and comfortable a client is with their lawyer, the better able the lawyer is to understand and assist with the case. How important is local knowledge to the success of your cases? Knowledge of friendly parties (i.e. Crowns, Judges, opposing counsel) is very important, as knowing who I'm dealing with allows me to determine the best case strategy and reach the most favourable result. What information can you provide in a free phone consultation? Each case is different. Sometimes a full assessment can be made as to the merits of a case and best manner in which to proceed. Other times, merely a cost breakdown can be given, with further substantive advice to be given during an in-person meeting. What information do you need in a free phone consultation? Name, contact information, and pertinent case information, e.g. upcoming court dates, courthouse, etc. What differentiates you from other lawyers in your community? I offer very personalized legal services; I do not delegate significant tasks to others, I do them personally. I give each and every client my cell phone number, which is on 24/7, so they can always reach me (rather than a receptionist, assistant or answering service) with any urgent inquiries. What is the most rewarding aspect of your job? Obtaining successful case results, thereby validating the client's decision to put their faith in me. What are your other interests in addition to law? I enjoy playing and watching hockey, and engaging in other adventure activities such as mountain biking and kitesurfing. I also like travelling, seeing different cultures and learning different languages. Are you involved in your community? I do my best to assist with at least one pro bono case each month within my community. |

He says Canada should dispense with the plan altogether. “It appears to be another layer of governmental bureaucracy that’s likely not going to serve its intended purpose,” he tells AdvocateDaily.com. The federal government quietly published a note July 29 deferring the firearm-marking regulations until June 1, 2017 – the seventh time Ottawa has delayed the measures, says the Canadian Press. The new regulations, first drafted in 2004 and previously scheduled to take effect Dec. 1, would require that specific, identifiable markings be stamped on firearms. The plan would require domestically manufactured firearms to bear the name of the manufacturer, serial number and ‘Canada’ or ‘CA,’ while imported guns would have to carry the ‘Canada’ or ‘CA’ designation along with the last two digits of the year of import, says the wire service. |

Competence, common sense, and compassion (for the client, not the opposing party). What information can you provide in a free phone consultation? I am happy to provide no charge advice to get the client pointed in the right direction, and can sometimes give them a few rough options or ideas on what to pursue. What information do you need in a free phone consultation? The story in a nutshell, what the client wants to achieve, and a rough budget. That's enough to get the client pointed in the right direction and to figure out next steps. What differentiates you from other lawyers in your community? My focus on achieving business results for the client, as well as my concern for client costs. I appreciate legal advice is expensive, but it doesn't always have to be if work can be tailored to a certain budget. I'd also say my familiarity with a wide range of areas of law is quite unique. What is the most rewarding aspect of your job? That would absolutely have to be helping people and solving problems. Are you involved in your community? Absolutely. I actively volunteer with a number of professional organizations and sit on boards of various non-profits. |

10 | 2017-07-13 23:59:24 | Richard J. Aitken | Criminal, DUI-DWI, Traffic, Felony, Misdemeanor | York Univ. LL. B. 1982 | In Good Standing | Our winning team of experienced Ontario criminal lawyers provides hope and real solutions to those charged with DUI, DWI, impaired driving or other criminal offences. We offer a free 30-minute consultation, affordable payment plans and we do not charge interest or for travel costs/mileage. ----------------------------------------------------------------------- After being called to the Ontario Bar in 1984, Richard Aitken began to focus his practice on criminal defence matters. Over the years, this focus shifted more and more to include cases involving DUI – the area of law that now forms the bulk of the Aitken Robertson practice. Mr. Aitken has been assisting clients with their DUI charges for over 30 years now. Mr. Aitken has extensive training on Standardized Field Sobriety Testing, Drug Recognition Evaluation and DUI trial tactics. He has completed a wide variety of DUI defence courses, such as his most recent ones including “Mastering Scientific Evidence in DUI/DWI Cases” in March of 2015, “Scientific Evidence in Impaired Driving Cases” in 2014, “A Recipe for Success – Trial Techniques that Win” in 2013, as well as several courses regarding further DUI tactics and training on both the Intoxilyzer 5000C and 8000C breath testing instruments in Atlanta, Georgia in 2014. Mr. Aitken’s practice extends to several different Ontario, Canada cities, including full-time operations in Peterborough, Oshawa, and Kingston, and satellite offices in Toronto, North York, Scarborough, Markham, and Ajax. Having these locations available to meet with new, prospective and current clients allows Aitken Robertson to offer proficient representation to accused persons all throughout central, eastern and southern Ontario, Canada. Lastly, Mr. Aitken is proud of a number of noteworthy cases. One example is on a summary conviction appeal, prepared by colleague Edwin Boeve, Mr. Aitken made arguments at the level of the Superior Court on a case that dramatically changed the law regarding when an accused person must be given rights to counsel. Lawyer.com Member Questionnaire Please describe a case(s) in the last year or two where you made a big difference. A quite presentable client approached Aitken Robertson after being charged with both driving while impaired by drugs and dangerous driving. Our client’s backstory was that he was struggling through some difficult times and had to have a routine medical examination – one that would require needles of which he had a great phobia. Prior to his examination, our client was prescribed a rather powerful anti-depressant to help with his nerves relating to the routine procedure. As a result of some miscommunication between the doctor, the pharmacist and our client, our client ended up taking a much higher dosage than what should be prescribed as it was unclear as to how many pills he was supposed to take. As a result – our client found himself behind the wheel after the procedure and the police had pulled him over. He was subsequently charged. At trial, our goal was to have the charges dismissed as a result of poor advice he had received from his doctor. Our strategy was to have our client testify in open court, and on the record, as he would clearly be an impressive and believable witness. We then proceeded to attack the credibility of the doctor and expose the misguided advice our client received. Ultimately, our client was acquitted of both sets of charges due to the negligence of the prescribing doctor. How did you build a successful practice? All good things come in time. I have been practicing law for over 30 years now and I have seen many a different things when it comes to law. Having dedicated my practice to criminal law – and more specifically – defending those charged with impaired driving, DUI and DWI, I quickly learned that while each case is unique in its own way, there was one particular constant. The client needs help. It may sound cliché to hear a lawyer say “clients come first” but it is an absolute truth at Aitken Robertson. Our experienced team of six (6) criminal defence lawyers have over one hundred (100) years of combined experience. If you hire one lawyer – you get another five (5) who offer insight and defence strategies on the case for the price of the one that you hire. Managing client expectations can often be troublesome but the lawyers and staff here at Aitken Robertson understand not only the complexity of some criminal matters, but also the stress that accompanies being charged with a criminal offence. There is a fine line between being a fighter and a friend and we have learned to be balance of both. We offer realistic objectives and seek realistic outcomes for each of our unique clients that walk through the door. What should clients look for in a lawyer? There are many things to consider when trying to find the best lawyer to defend your personal interests as you navigate through your current matter before the courts. For starters, a client should ask whether a particular lawyer specializes in the particular area of law that you require them to assist you on. For example, while my practice fights all criminal charges – we specialize in the area of DUI as it is the area of law we know the most about and the area of law we have been the most successful in. Experience is an asset. In addition, a client should ask whether the lawyer has any specialized training in the particular field. I myself and the other lawyers I employ have specialized training on the Intoxilyzer breath machine the police use at the station, as well as the Alcotest roadside breath instrument. We also continuously update our training by attending many seminars on Standardized Field Sobriety Testing and Drug Recognition Evaluation. We are taught by some of the most prestigious DUI attorneys in the United States with countless years of DUI defence and this training is something that the majority of Canadian lawyers don’t have. Other things that a client should consider include whether the lawyer belongs to any particular professional organizations that are devoted to a particular area of law, how successful is the lawyer in defending clients, what sort of support is available at the firm and how much a particular matter will cost. It is also important to know whether money is required up front or if the lawyer offers affordable payment plans to assist the client through their difficult time. How important is local knowledge to the success of your cases? Local knowledge of the local system is beneficial in defending the interests of our clients. While navigating the justice system is made up much of knowing the law and applying it to any given case – it is also advantageous to manage relationships between other lawyers, the Crown attorney and the presiding Judge or Justice of the Peace. Something may unexpectedly arise that may require a sudden change in your approach to a client’s matter and it helps the case if you are in good rapport with the local Crown, Judges and court staff. It is also beneficial to know who and what you are facing when you go into court. Certain jurisdictions with an increased rate in particular crimes/offences may be more strict in terms of how a matter is approached and knowing this in advance of attending court will prevent being blind-sided should something else that is unexpected happen. |

Lawyer.com Member Questionnaire Please describe a case(s) in the last year or two where you made a big difference. I assisted my client in selling his business. Later we found out that there was a problem with a required filing under the Excise Tax Act that would have exempted transaction (acquisition of an entire business) from application of GST. CRA proposed to reassess my client for tens of thousands of dollars as he was a seller and as such responsible for collecting and remitting GST. If CRA’s reassessment was confirmed, my client would have to pay to the CRA, then sue the purchaser for the same amount, then the purchaser (provided my client’s lawsuit was successful) would have to pay to my client and claim from the CRA for that amount to be reimbursed – thus, money would have travelled the full circle to bring about the same result as if no reassessment had occurred except that all the parties would have had a couple of years of dealing with it, spending time and money. CRA’s position was technically correct, but I worked with the agent, team leader and the manager and convinced them to not reassess. How did you build a successful practice? I like what I do. I constantly read up on it to stay on top of all new developments. I like using that knowledge and interest for devising ways to solve clients' problems, or better yet to devise a structure that avoids them. What should clients look for in a lawyer? At the initial contact: Someone who listens. Someone the client can trust. Someone who understands the clients' position/goal. Someone you can work with.Later on: The quality of the work the lawyer does; how punctual the lawyer is, how responsive he or she is. What information can you provide in a free phone consultation? Determine whether a person actually needs a lawyer, what type of law and what are the first steps; Whether there are any first steps the clients take themselves; If nothing can or should be done by the clients, how to prepare and what documents to bring for a meeting with a lawyer;Timing issues – whether the matters shall be attended to urgently or there is still time. What information do you need in a free phone consultation? The client should be able to describe the situation, so that a lawyer can identify the issues and then determine what needs to be done: whether the clients are in a position to resolve the situation or a part of it themselves or whether they need a lawyer and how urgently. What differentiates you from other lawyers in your community? I am a corporate, commercial, business and tax lawyer – I specialize in tax, including tax planning for individuals and corporations, estate planning, resolving tax disputes - corporate, commercial and business law are instrumental in implementing tax structures. On the other hand, tax is an important consideration for the corporate, commercial and business transactions. So, I see the areas I practice as complimentary to each other. What is the most rewarding aspect of your job? Solving a difficult issue;A job well done – when results are achieved and clients are content – I am happy for the client and for myself; The clients saying thanks and coming back every time they need advice. 36 | 2017-07-14 00:02:16 | Kevin Heinrichs | Divorce & Family Law | Dalhousie 1992 | In Good Standing | Kevin Heinrichs is a partner in Henderson Heinrichs. He received his Bachelor of Arts degree from Simon Fraser University in 1988 with a major in Political Science and a German minor. In 1989, he began attending Dalhousie Law School in Nova Scotia and graduated in 1992. After articling for one year, he passed the British Columbia Bar in 1993. Since that time, he has practiced solely in the area of family law. He has appeared in all levels of the British Columbia court system and have lectured in the community on all aspects of family law. In 1997, Rain Henderson and Kevin Heinrichs set out to create a law firm which would provide legal advice to clients on the whole range of family law issues, but without the pretension sometimes associated with our business. The breakdown of a relationship causes people enough stress and confusion, and our aim in forming Henderson Heinrichs was to make sure that the legal process did not add to that stress. Kevin Heinrichs believe it is very important that people understand what the law says about their situations, that they know how the legal process works and that they make the decisions that affect their lives. Because of that, he involve his clients in every facet of the process, from initial discussions regarding what is possible, to negotiations, to court appearances. He consults with our clients every step of the way and present all options and advice to them in a clear, unconfusing manner so that they can decide what is best for themselves. Because Kevin Heinrichs has been practicing family law since 1993, his opinions and advice are valuable. Kevin can often present options that clients did not realize existed and give my true opinion on the expectations that clients present. Kevin does not hesitate to say exactly what he thinks, and he will not sugar-coat my opinion of a client’s situation. Every client has a right to know exactly what their legal situation is, to know what is possible and what is not. Kevin believes that negotiation is important, and if acrimonious and expensive court attendances can be avoided without hurting my client’s interests, settlement is certainly something which should be explored. He will not, however, advise clients to settle when it would hurt their interests, and will not shy away from tenaciously challenging an unfair position in court. Of all the family law issues our clients face, the most difficult and the most important are those dealing with children. Heinrichs believes that children’s interests have to be placed at the forefront when a relationship breaks down, and that they be avidly protected. It is important that clients understand what words like guardianship, parenting responsibilities and parenting time mean so that they can make informed decisions regarding their children’s lives. It is equally important that they be informed about all available options regarding their children so that they do not have to settle for anything less than what is best. Kevin Heinrichs will continue to practice family law in the manner that Henderson Heinrichs has come to stand for, and look forward to meeting with anyone who needs assistance, guidance and clarity. |

37 | 2017-07-14 00:02:19 | Marcus M. Sixta | Divorce & Family Law | U of Calgary J.D. 2011 | In Good Standing | I am a family law lawyer / divorce lawyer who strives to provide clients with exceptional service in the following areas: divorce, child custody, guardianship, parenting time, child support, spousal support or alimony, matrimonial property division, prenuptial agreements and cohabitation agreements, unjust enrichment, child protection, restraining orders, adoptions, adult guardianship and trusteeship, Hague Convention on international child abduction cases and mediation. I was a social worker before becoming a family law lawyer and I completed my articles with Alberta Justice where I worked in child protection, criminal prosecutions, appeal and the office of the Public Trustee. This background gave me the skills to assist people working through difficult divorces and family law disputes. It also gave me significant courtroom experience and I have conducted numerous trials and hearings in court on family law cases. I believe that my clients are best served by avoiding unnecessary litigation. I use my unique experiences and training to assist parties in coming to negotiated settlements in order to reduce conflict. However, I also believe that sometimes clients are best served by strong advocacy within the court system. I also have experience as a third party mediator. He also handles a variety of other personal injury claims including slip and fall matters, as well as estate litigation cases. Until 2002, Wes’ practice primarily involved ICBC defence work with two of the largest insurance defence firms in the province. As a result, he gained extensive knowledge of ICBC’s practices, much of which is now published in his book. Since 2002, Wes has devoted his practice to helping people pursue injury claims against ICBC and other insurance companies. The knowledge he gained as an ICBC defense lawyer puts Wes in a unique position to manage ICBC’s defense tactics on behalf of his injured clients. He also continues to help others grow within the legal field by coaching law students as well as paralegal students to local colleges and the University of Calgary. Lawyer.com Member Questionnaire Please describe a case(s) in the last year or two where you made a big difference. Please see the cases below titled, "Nearly Destroyed by Bureaucracy," and "Lawyer Warrington Pulls It Off Again!" How did you build a successful practice? I built a successful practice by bringing files to closure, settling out of court, and by specializing in custody, abduction and child mobility matters. I became a successful trial lawyer and qualified as a mediator. What should clients look for in a lawyer? If they are willing to meet out of court to settle. How important is local knowledge to the success of your cases? This is hard to say; I rely upon local mediators to assist in settling and local psychologists for child appraisals. What information can you provide in a free phone consultation? I follow up with a draft custody and access draft order. What information do you need in a free phone consultation? If there are kids involved, if they own property, the date of separation, length of relationship, and a list of assets and debts. What differentiates you from other lawyers in your community? I encourage, even insist that clients work out as many issues as they can with their spouse, or we proceed with mediation, as a pre-requisite to court. What is the most rewarding aspect of your job? The most rewarding aspect of my job is getting settlement to a difficult file, and wrestling children back to this province after being abducted. What are your other interests in addition to law? My other interests are the outdoors, history, and fly fishing. Are you involved in your community? I am involved with the Board of Directors to an Outdoor Club and the Board of Governors to the Army Cadet League of Alberta (youths of the army cadets). I promote, market, and recruit for the Alberta Army Cadets (youths 12 – 18). Since 2004, I have been a volunteer with a host of youth groups, coach for the biathlon, and cross country ski. I have fostered a few youths in my home, and fundraise and purchase/donate musical instruments to a youth band. |

Helen started law school at age 39, after two decades as a paralegal. After graduating from the Faculty of Law at the University of Alberta in 2011, she developed a general practice at a small firm in Central Alberta. Homesick for Calgary and its more hospitable climate, Helen returned to Calgary in June, 2015. Helen uses a “carrot and stick” approach to family law, meaning that she utilizes the least adversarial approach possible first, keeping in mind that the parties may be forced to maintain a relationship after the legal issues have been resolved. However, in situations where a conciliatory style and mediation is ineffective, Helen is an effective litigator who advocates for her clients’ rights. Helen has experience Provincial Court, the Court of Queen’s Bench and the Alberta Court of Appeal. Helen accepts legal aid files. She currently volunteers at the Calgary Women’s Centre and also hosts free seminars on family law topics (look for her Family Law Seminars Meet-Up on the Meet-Up App). Her past volunteer experiences include the Camrose Women’s Shelter and the Vancouver Crisis Centre. In her off hours, Helen enjoys drinking wine, travelling and watching documentaries. |
